A car accident can change your life or a loved one's life. For example, if someone you love is killed in a car accident, the emotional and financial distress you face can be overwhelming. Colorado Law Concerning Injuries or Death Caused by Car Accidents
Colorado law requires every owner of an automobile in the State of Colorado to have two types of mandatory insurance:
- Property damage liability coverage - this coverage provides compensation to another person for damage to their automobile caused by the at-fault driver.
- Bodily injury liability coverage - this coverage provides compensation to another person for bodily injuries sustained in a motor vehicle collision. The State of Colorado requires that every owner of an automobile have at least $25,000.00 in bodily injury liability insurance coverage.
In Colorado, the person who caused the accident (the at-fault driver) and/or their insurance company is responsible for all of your accident-related injuries, damages and losses, up to the amount of coverage available on the at-fault driver's insurance policy. You may also be eligible to receive compensation for medical bills, funeral expenses, and emotional distress if a loved one you know dies as a result of an accident that is not your fault.
To establish a claim for your personal injuries related to a motor vehicle accident, the following three requirements must be met: 1) you must prove that you have suffered injuries; 2) you must prove that your injuries were caused by the auto accident, and not some other accident or incident; and 3) you must prove that the auto accident was not caused by you. Under Colorado law, if you are found to be more than 50% at fault for the accident, then you are not entitled to a jury verdict if the case goes to trial. Therefore, early and proper investigation is critical to proving that you are not 50% or more at fault.
You are entitled to recover the following types of damages: 1) economic damages, which include past and future medical expenses, past and future lost wages, impairment of earning capacity, and other out-of-pocket expenses; 2) non-economic damages, which include inconvenience, loss of quality of life, emotional distress, pain and suffering; and 3) physical impairment and disfigurement.
Law Concerning Injuries or Death caused by Trucking Accidents
Accidents involving commercial trucks and smaller private passenger vehicles often result in serious injuries or death for the occupants of the smaller vehicle. For example, consider that a large commercial truck can weigh as much as 80,000 pounds and can be as long as 75 feet. In comparison, smaller private passenger cars and vehicles can range from a bicycle to a 2,500-pound car or a 4,000-pound SUV. Therefore, it is not hard to see why collisions with these trucks often cause serious and catastrophic injuries.
Commercial truck drivers are specially trained and must follow certain state and federal regulations that the average car driver does not. These regulations are designed to protect both the truck driver and other drivers on the road. Therefore, a truck driver who fails to follow any of these regulations may be increasing the likelihood of a serious accident.
It takes considerable knowledge and resources to adequately investigate and prepare a truck accident claim to ensure that the victims' rights are protected. The truck accident attorneys at The Law Firm of William Babich, LLC, in Colorado understand the traffic laws that apply to commercial vehicles and the requirements that truck drivers must follow. We believe it is our responsibility to help protect you and your family from trucking accidents caused by the negligence of truck drivers and commercial trucking companies that refuse to follow these standards.
Law Concerning Injuries or Death caused by Motorcycle Accidents
Motorcycle accidents and injuries can be caused by a number of factors, including defective roadway designs, poor weather conditions, product defects (including defective tires or defective helmets), and the recklessness or negligence of other drivers. Because motorcycles do not offer the physical protection that cars do, motorcycle riders are much more vulnerable to serious injuries, such as traumatic brain injuries, broken limbs, road rash, and other serious conditions, or even death. In Colorado and throughout the country, motorcycle laws are in place to prevent such injuries and deaths. Unfortunately, thousands of motorcycle accidents continue to occur each year. A motorcycle accident attorney at The Law Firm of William Babich, LLC, can help victims throughout the United States obtain compensation for their injuries, damaged or lost property, medical bills, lost wages, pain and suffering, and other damages.
